Welcome to LogoGenie (“the App”). Please read these Terms & Conditions (“Terms”) carefully before using the App. By downloading, accessing, or using LogoGenie, you agree to be bound by these Terms and by our Privacy Policy (collectively, the “Agreement”). If you do not accept every part of the Agreement, do not use the App.

1. Who May Use LogoGenie

1. You must be at least 13 years old (or the minimum digital-consent age in your country) to create an account.
2. If you are under 18, you must have a parent or legal guardian review and accept these Terms on your behalf.

2. Your Account

• Accuracy: You agree to provide accurate, complete information when creating an account and to keep it up to date.
• Security: You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• Deletion: You may delete your account at any time from Settings › Delete Account; this action permanently removes your logos, credits, and personal data.

3. Subscriptions, Credits & Payments

• Plans: LogoGenie offers paid subscriptions that grant weekly logo-generation credits. Details of features, credit amounts, and prices are displayed in-app.
• Billing: Payments are processed by Apple App Store or Google Play. Taxes may apply.
• Renewals: Subscriptions renew automatically until you cancel through the App Store or Google Play settings at least 24 hours before the end of the current period.
• Refunds: All purchases are final. Refund requests are handled solely by Apple or Google under their respective policies.
• Changes: We may modify subscription fees with at least 30 days’ notice. Continued use after the effective date constitutes acceptance.

4. License & Intellectual Property

1. Our rights

   • All software, design, text, graphics, and other content in LogoGenie (except user-generated content) are owned by JoyByte Studios or its licensors and are protected by intellectual-property laws.
   • We grant you a personal, non-exclusive, non-transferable, revocable license to use the App solely for lawful purposes in accordance with these Terms.

2. Your logos

   • You retain all rights to the logos and images you create with the App, subject to any third-party model or data restrictions.
   • You represent that your prompts, styles, and other inputs do not infringe any third-party rights and do not violate applicable law.
   • JoyByte Studios does not claim ownership of user-generated logos but may store and display them to you inside the App.

3. Feedback

   • Suggestions or feedback you provide may be used by us without compensation or obligation to you.

5. Acceptable Use

You agree not to:

• Use the App to create or share unlawful, harassing, defamatory, hateful, or otherwise objectionable content.
• Violate any applicable law or regulation.
• Reverse-engineer, decompile, or gain unauthorized access to any part of the App or its systems.
• Interfere with or disrupt servers or networks connected to the App.
• Sell, resell, or sublicense the App or any portion of it without written permission.

We reserve the right to remove content or suspend accounts that violate these rules.

6. Termination

• By you: Delete your account at any time in Settings.
• By us: We may suspend or terminate your account immediately, without notice, if you violate these Terms or if we discontinue the App.
• Upon termination, your license to use the App ends, and all credits become void.

7. Disclaimers

• The App and all generated content are provided “as is” and “as available.”
• We do not guarantee that the App will be uninterrupted or error-free.
• We make no warranty, express or implied, regarding fitness for a particular purpose, non-infringement, or accuracy of generated logos.

8. Limitation of Liability

To the maximum extent permitted by law, JoyByte Studios and its affiliates will not be liable for:

• Indirect, consequential, incidental, punitive, or special damages;
• Loss of profits, data, or goodwill;
• Aggregate liability exceeding the greater of (a) amounts you paid to us during the 12 months preceding the claim or (b) USD 50.

Some jurisdictions do not allow certain limitations; in such cases, these limitations apply to the fullest extent permitted.

9. Indemnification

You agree to indemnify and hold harmless JoyByte Studios, its directors, employees, and partners from any claims, damages, or expenses (including legal fees) arising out of your use of the App, your content, or your violation of these Terms.

10. Governing Law & Dispute Resolution

• These Terms are governed by the laws of Bangladesh, excluding conflict-of-laws rules.
• Any dispute shall be resolved exclusively in the courts located in Dhaka, Bangladesh, unless mandatory law provides otherwise.

11. Changes to These Terms

We may update these Terms from time to time. If a change is material, we will notify you in the App or on our website. Continued use after the effective date constitutes acceptance of the revised Terms.
